MONTHLY MEETING MONDAY 9TH NOVEMBER 2009
MINUTES OF PROCEEDINGS AT MONTHLY MEETING OF THE COBH TOWN COUNCIL, HELD AT CARRIG HOUSE, COBH, ON MONDAY 9th NOVEMBER, 2009



Presiding - Cllr. P. Whitty, Mayor.

Present - Cllrs. P. Histon, S. O’Connor, J. Mulvihill, M. Martin, S. Sheppard, J. Quinlan, and F. O’Driscoll.

The meeting commenced with the recitation of the Lord’s Prayer.


1 CONFIRMATION OF MINUTES.

Monthly Council Meeting Monday 12th October, 2009 – Adoption proposed by Cllr Mulvihil and seconded by Cllr Martin.



2. MATTERS ARISING FROM MINUTES

Cllr Mulvihill in reference to a request for new computers stated that a suggestion may be for retired Councillors to return their computers.

Cllr Martin in reference to the demand for the skateboard park stated that the resources existed to do fundraising if the land necessary was made available.

Cllr O’Connor asked for a report on the issue of anti-social behaviour in Council estates. The Town Clerk replied that section 62 of the 1966 Act was recently found to be incompatible with the European Court of Human Rights. He also stated that Local Authorities were seeking legal advice on the matter and were looking at drafting new policies.

Cllr Sheppard asked for a report on noise emissions from the Naval Base at Haulbowline. The Town Clerk replied that there was no reply to a letter from Cobh Town Council and the Navy were not subject to planning laws. The matter was still ongoing.

Cllr Mulvihill asked if schools had been contacted regarding the Student Council – letters had been sent to transition year co-ordinators.


3. VOTES OF CONDOLENCE.
The Sympathy of the Council was extended to all those who had died since the previous meeting of the Council.


4. MANAGER’S ORDERS

Regarding the appointment of tenants a number of Councillors expressed concerns that a number of offers were refused. Cllr Mulvihill expressed dismay at the number of refusals while Cllr O’Driscoll stated that there now had to be concerns about the reputations of some council houses. The Town Clerk replied that some of those refusing offers of housing had specific valid reasons.

ii. Cobh & Harbour Chamber, cobh.ie – The Town Clerk stated that there was a cost issue associated with this proposal but that he had no objection to it in principle.

v. Notice of Motion; Listowel Town Council – marked as read.
vi. Notice of Motion; Shannon Town Council – marked as read.
vii. AMAI; notice of subscription – Cllr Martin queried the value of the subscription. Cllr Mulvihill replied that the AMAI undertook lobbying of government in relation to matters such as An Bord Snip Nua, Garda Bill etc.
viii. Notice of Motion; Granard Town Council – marked as read.
ix. South Tipperary County Council; Notice of Council – marked as read.
x. An Garda Siochána; Drinking Bye-law – marked as read.
xi. NPPR – marked as read.
xii. Port of Cork re request for pontoons – marked as read.
xiii. Derek O’Gorman, Personnel Department – .In relation to the proposal for volunteers to work on Town Council houses Cllr Martin stated that he did not think Health & Safety legislation applied to volunteer work. Cllr Quinlan stated that the letter from the personnel department was disappointing and the offer of professional work on a voluntary basis should be considered. Cllr O’Connor stated that it was a genuine proposal regarding unoccupied houses and asked if specific funding was available for such houses. The Town Clerk replied that such funding in question relates only to whole estate regeneration. Cllr O’Driscoll asked that the specific Health & Safety issues should be established. The Town Clerk stated that staffing issues were also a problem. Cllr Mulvihill stated that CE schemes were the obvious solution to the problem. Cllr Martin also said that the Council should continue to pursue the issue. It was therefore agreed to
1) Revert to Personnel Department
2) Resurrect CE schemes
3) Write to the Minister for Employment

xiv. See you in Cobh; Christmas lighting – agreed to thank group for their initiative.
xv. Cobh Tidy Towns; Award for railings – Cllr Histon and Cobh Tidy Towns were congratulated.
xvi. Cobh Tourism; Tourism planning workshop – agreed to send delegates.



6. DISPOSAL OF FREEHOLD - To consider the disposal pursuant to Section 90 of the Housing Act, 1966 and Section 26 of the Landlord and Tenant (Ground Rents)(No 2) Act 1978 of the following freehold

• 8 Glenanaar Place, Cobh,

This was proposed by Cllr O’Driscoll and seconded by Cllr Mulvihill.


7. OFFICERS REPORT
The Town Engineer gave a report on the following matters
i. The Spires, Carrignafoy – included in list of works.
ii. Newtown Road – on list for Cork County Council for re-alignment.
iii. Costcutters – will investigate possibility of a centre Island but there maybe sightline issues.
iv. Proposed sale of sites – can examine other suggested site.
v. Kidney Strand – sewer and the development in question. Cllr Histon stated that the wall and steps near the development were a problem.
vi. Gullies at Top of Hill – to be cleared.
vii. Colman’s Square – kerbing to be reset by Cork County Council.


8. COMMITTEE REPORTS

i. Ploermel Twinnings – Grant of €8,000 received.



9. REVIEW OF BYE LAWS
It was agreed to meet in-committee on Monday 16th November at 5.30pm to discuss the review of Bye-laws.

It was also agreed to begin monthly Council meetings to 5.30 in the future.


10. To consider the following Notice of Motion standing in the name of Cllr. Michael Martin

“That Cobh Town Council facilitate a survey of the residents of appropriate housing estates to assess the demand for and necessity of speed ramps to reduce the incidence of speeding and protect residents and their children”
Cllr Quinlan seconded the motion and agreed that it was a very live issue. He also stated that there was however extreme differences of opinion about speed ramps. Cllr Mulvihill stated that there should be a policy that when taking over housing estates speed ramps are put in place by the developer. Cllr O’Driscoll stated that guidelines existed regarding the length of the road that would be an impediment to ramps. Cllr O’Connor also agreed that the criteria also would exclude some estates.
The Town Engineer stated that a survey of average speeds would need to be done to assess need would need to be done. The average cost of each ramp was €2,000 and they were not wanted in many estates.
Cllr Whitty quoted the example of Wexford where Gardai measured the decibel level of exhausts. He also suggested that Cobh Town Council should facilitate a survey of residents on the issue of speeding and ramps. The Town Clerk stated that the guidelines would have to be circulated firstly. Cllr Quinlan stated that the action of carrying out a survey would be a step in raising awareness.



11. ANY OTHER BUSINESS PROPER TO THE MEETING

i. Ring Road through College Manor – proposal to take ring road in charge as it was ready to be opened – T.E. to examine.
ii. Ownership of Archway at 52 Springfield Park. The Town Clerk stated that both sides needed to be in agreement.
iii. Gutters at 62/63 Springfield Park – T.E. to examine.

Cllr Mulvihill
i. Railings and ramps at Whitepoint moorings – T.E. to examine
ii. RPPI; - further meeting needed in Cobh – Town Clerk to examine.

Cllr Histon
i. Access gates between Pearse and Casement Squares – Town Clerk to discuss with the Town Foreman.



Cllr Quinlan
i. The wall at rear of house on Bond Street (McGann’s) needs repairing – T.E. to examine.
ii. Traffic calming on approach to town from Ticknock near St. Mary’s N.S such as a traffic Island or T-Junction – T.E. to examine.


Cllr Martin
i. “Hospital” signs directing motorists to Cobh Hospital needed on approach roads from Ticknock, Cuskinny, Rushbrooke – T.E. to examine.
ii. Examine dangerous junctions & sightlines and make recommendations for safer traffic exits onto public roads.
