MINUTES OF PROCEEDINGS AT MONTHLY MEETING OF THE COBH TOWN COUNCIL, HELD AT CARRIG HOUSE, COBH, ON MONDAY 13th OCTOBER, 2008


Presiding - Cllr. J. Mulvihill, Mayor.

Present - Cllrs. N. Doyle, S. Meade, P. Histon, D. Crowley, S. O’Connor and P. Whitty.

The meeting commenced with the recitation of the Lord’s Prayer.

OPENING OF TENDERS: COBH LANDSLIDE PROGRAMME
The Tenders for two of the companies (Cumnor Construction & PJ Hegarty) that were invited to tender for the project were opened. They will now be referred back to JODA consultants.


1. CONFIRMATION OF MINUTES

On the proposal of Cllr O’Connor seconded by Cllr Whitty the minutes of the following meetings were adopted.

Monthly Council meeting – 8th September 2008


MATTERS ARISING


ST COLMAN’S CATHEDRAL – In response to a query from Cllr O’Connor the Town Clerk stated that stated that the works carried out did not require planning permission.

DERELICT SITES; 1 & 2 CASEMENT SQUARE – The Town Manager stated that planning permission was granted on the 20th September and that there had been no third party objections.

AFFORDABLE HOUSING IN MARINEGATE – The Town Clerk stated the housing units were not ready as a number of minor issues had yet to be dealt with. He stated that he hoped to be in a position to have the selection process completed by the next meeting.

MASTER PLAN – The Town Manager stated that a meeting had taken place with the consultants and that it was hoped the contract would begin the following Monday. There was however a matter with professional indemnity to be resolved.

CONDITION OF TOILET BLOCK – The Town Engineer stated that new gates had been erected. He also stated that the use Airwick sprays was being investigated as well as more frequent servicing. The Town Engineer also stated that a costing was being done for painting of the toilets.

FUTURE OF COBH POST OFFICE – The Town Clerk stated that he had received a phone call from An Post with a view to a meeting with them.

IARNRÓD ÉIREANN – The Town Clerk stated that he received a letter from Andrew Roche in relation to dates of works on the rail line.

RADON TESTING OF COUNCIL HOUSING – The Town Clerk stated that details of the Council’s housing stock were being forwarded to Cork County Council.

LOCAL GOVERNMENT STATUTORY AUDIT REPORT FOR YEAR ENDED 31 DECEMBER 2007 – In response to a query from Cllr Whitty at a previous meeting the Town clerk stated that the ‘miscellaneous item’ refers to capital transfers.

CARRIGNAFOY LEISURE LTD– Cllr Crowley stated that the directors were hoping to meet with Aura to discuss the swimming pool.

COLLEGE MANOR – The Town Engineer stated that the College Manor estate still remained a private site and that the developer was responsible for the estate but he stated that Cork County Council would be in contact with the developer. In response to queries from a number of councillors in relation to taking the road in charge the Town Clerk stated that the legal position was that if the Local Authority wished to take the road through the estate in charge that they would also have to take the whole estate in charge.

WHITEPOINT PLANNING – The Town Clerk stated that the site was now closed. Cllr O’Connor stated that the guidelines were not being adhered to. The Town Clerk stated that he had written to the developer and that no works had been carried out since. Cllr O’Connor however stated that a wall had been knocked and that this contravened the guidelines given. Cllr Doyle also stated that this opening should not have been made and this view was supported by Cllr Meade.


SALE OF SITE AT BISHOP ROCHE PARK – The Town Clerk stated that the decision was made to develop the upper side of the site. Cllr O’Connor stated that he wished to propose selling the site near the council shed and build two council houses on the remaining site. Cllr Mulvihill supported Cllr O’Connor’s proposal and it was agreed to sell this site including the shed.
Cllr Histon queried the entry onto the second site. In response the Town Clerk stated that there were planning issues concerning entry through the park. Cllr Mulvihill asked the Town Engineer to report together with the Town Clerk to the next meeting.

LOCAL BUS SERVICE – An acknowledgement was received from the Department of Transport. Cllr Mulvihill stated that he was in contact with the manager of the bus company.


2.VOTES OF CONDOLENCE

The Sympathy of the Council was extended to all those who had died since the previous meeting of the Council.

The votes were passed in silence all standing.

3.MANAGERS ORDERS
Cllr Meade proposed acceptance of the Managers Orders and this was seconded by Cllr Doyle.

4. CORRESPONDENCE –
a) Cobh & Harbour Chamber – Water charges – marked as read
b) St Hermine twinning – Council not interested in twinning.
c) Andrew Roche Iarnród Eireann – marked as read
d) Joint Policing Boards – marked as read
e) Ballymore cycling – On proposal of Cllr Mulvihill it was agreed to discuss at Budget.
f) Notice of motion from Monaghan Town Council – marked as read.
g) Notice of motion from Bandon Town Council – marked as read.
h) Notice of motion from Bantry Town Council – marked as read.
i) Notice of motion from Ballinasloe Town Council – marked as read.
j) Department of Transport re local bus service – marked as read.
k) European Federation of Sea Anglers – marked as read.
l) Chairperson of Russell Heights Residents Association – provision of funding – Cllr Mulvihill stated that a report would be made to the council after meeting the chair of the residents.
m) Titanic Committee – letters from interested groups and individuals (5).

5.OFFICERS REPORTS
1) Landslide Study – The Town Clerk stated that the consultants are carrying out a preliminary study and it was hoped that it would be completed by the end of October and more detailed works would begin in January.
2) Tourism walking trails – The Town Clerk stated that funding from Fáilte Ireland was available and after meetings with Cobh Tourism they were ready to advertise for tenders for signage.
3) Industrial lands at Ballynoe – The Town Clerk outlined the proposals drawn up by the Council Architects and as submitted to the Department. He stated that they had been approached by local businesses and more details were being requested of them. Cllr Whitty questioned why recreational facilities had not been included in the plans. Cllr Doyle stated that the original proposals included community pitches. The Town Manager stated that the problem lay with the topography of the lands which meant they were not very suitable for playing pitches. The Town Clerk stated that the planning application would in any case be bound by recreational policy and that it was an issue for Cork County Council not the Town Council. Cllr Doyle stated again that she was unhappy with the changes to the original plans. The Town Clerk stated that the proposals also had to adhere to density guidelines and the placing of pitches would impact on this. The Town Manager stated that the Architects could be asked to re-examine the plans. Cllr O’Connor stated that the site for industrial purposes would be very useful. Cllr Crowley that a Civic Amenity site was necessary and could be located there and he also stated that he would not support any proposals that did not include amenities. The Town Clerk stated that there was a community centre in the plan.


6.COMMITTEE REPORTS –
1) Joint Policing Committees – Cllr Mulvihill stated that they would advertise for community groups to come on the committees. Cllr Whitty asked that the Town Clerk set up a steering committee to establish the policing committee. Cllr Mulvihill agreed to arrange this and to report back to the council.
2) Cobh Museum - Cllr Whitty stated that essential repairs to the museum were planned and thanked The Town Architect, the Town Engineer and the Town Manager for their efforts.
3) East Cork Mayors – Cllr Mulvihill stated that the issue of litter and chewing gum near schools and the possibility of having a litter warden at schools as a deterrent were discussed.
4) AMAI Conference – Cllr Crowley stated that Minister Michael Finneran stated that the Town Councils Housing grants. Cllr O’Connor stated that the conference was very disappointing.
5) Sirius Arts Centre – Cllr Crowley outlined the recent launch of the ‘Green Book of Cobh’ done by students in Cobh and asked for it to be displayed.
6) Irish Steel – Cllr Mulvihill stated that the Ministers report at the end of October
7) Titanic Centenary Commemoration – The Town Clerk outlined the submissions of interest received. Cllr Mulvihill stated that Dermot O’Mahony of the Port of Cork was to be involved. Cllr Doyle asked if funding was available from Fáilte Ireland for an International event.

7. DRAFT RATES SCHEME 2008– Cllr Mulvihill welcomed suggestions. Cllr Doyle stated that it was a good idea. Cllr Whitty stated that they were a worthwhile experiment. The Town Clerk stated that approval would have to be sought from the Minister before being passed at a budget meeting.

8. DISPOSAL OF PROPERTY – To consider the disposal of the freehold of 32, Phillip O’Neill Place, Cobh pursuant to section 90 of the housing act, 1966 and section 26 of the landlord and tenant (ground rents)(no.2) act 1978.
This was proposed by Cllr Meade and seconded by Cllr Whitty

9. NOTICE OF MOTION
To consider the following notice of motion standing in the name of Cllr. John Mulvihill:
“That Cobh Town Council consider the establishment of a Youth Council in partnership with Cobh Community College and Coláiste Mhuire Cobh”. Cllr Mulvihill outlined the motion which was seconded by Cllr Crowley. All the members present expressed support for the motion.

10. NOTICE OF MOTION
To consider the following notice of motion standing in the name of Cllr. John Mulvihill:
“That Cobh Town Council again call on the Radiological protection Institute of Ireland to organise a public Information seminar in the town of Cobh in relation to the high percentage of homes on the Island and east Cork whose exposure to Radon gas is in excess of 200 Bq/m3, that the Radiological Protection Institute of Ireland treat this matter with urgency”
Cllr Mulvihill outlined the background to the motion and expressed his concerns on this matter and stated that he was unhappy at having to once again bring the motion to the council. Cllr Mulvihill stated that he felt that the Radiological Protection Institute of Ireland were being negligent and asked the Town Clerk to raise the matter with them.
The motion proposed by Cllr Mulvihill was seconded by Cllr Crowley and supported by all members present.



A proposal for an extension of time was proposed by Cllr Whitty and seconded by Cllr Made.

11. ANY OTHER BUSINESS –
i) Cllr Crowley in relation to Seacat ferries spoke of reports at the last meeting and felt that he was being mis-represented. The Cllr stated that he stood by his comments in relation to the objector and its appropriateness. Cllr Whitty stated that he had spoken to Mr Hendrick Verwey in relation to his objection. Cllr Doyle asked if Cobh Tourism were supporting the project. In response Cllr Whitty stated that Cobh Tourism was supporting the project and it had provided a letter of support.
ii) Cllr Whitty complimented the execution of the footpath and road repair programme.
